Two Drivers Arrested for DWI in Two Crashes at the same Houston Accident Scene
In the early morning hours of October 10, 2019, two drivers were arrested under suspicion of driving while intoxicated (DWI) following unrelated accidents. In an unusual twist, the collisions happened at the same spot, but several minutes apart.
Shortly after midnight, Houston police responded to the scene of a car accident on Interstate 10 at Kirkwood. According to the police report, a driver crashed into a stalled tractor-trailer on the shoulder of the Katy Freeway. Because of the risk of fire, law enforcement called in the fire department to secure the scene. When fire trucks arrived, they blocked a lane of traffic to protect the scene. During their investigation, police determined that the driver was intoxicated and placed him under arrest.
While the fire trucks were still on the scene, a second driver approached at high speed, before crashing into one of the fire trucks. Law enforcement also suspected the second driver was under the influence of drugs or alcohol. The police arrested the second driver as well.
While these drivers both face serious consequences given the facts of their arrest, the steps they take after a crash could make things worse. Below are some important things to remember following a DWI arrest.
What to do Following a DWI Arrest in Houston TX
Everything you do or say following a DWI arrest could be used against you during your trial. With this in mind, it is important to tread carefully. The police will encourage you to talk about yourself and what you were doing up until the DWI arrest, even without directly asking you any questions. These four steps will go a long way toward helping your DWI defense:
- Don't Speak. You are required under Texas law to provide police with identifying information, including your name, address, and driver's license. However, you are under no obligation to discuss anything else whatsoever. The more you say about your day, your life, or the arrest, the more likely you could trip up and say something incriminating. The police are not above twisting your words our taking them out of context.
- Do Not Plead Guilty at Arraignment. In most cases, you will be released the day after your DWI arrest. However, in some cases, you could be required to stay behind bars until your arraignment. At your arraignment hearing, you will be asked to plead guilty or not guilty. Pleading guilty is never in your best interest, as you give up your right to a trial and risk the judge sentencing you to the maximum.
